Gomeds 24/7 Customer Terms and Conditions of Use
This Customer Terms and Conditions of Use ("Terms") constitute a legally binding agreement between you ("User," "Customer," "you," or "your") and AEON HEALTHCARE, a partnership firm incorporated under the laws of India, having its registered office at ‘GIRIRAJ’ 162/A, Opp. Panna Terrace Flats, Beside Swara Blossom Flats, Atabhai Chowk, Bhavnagar, Gujarat, 364002, operating the platform GOMEDS 24/7 ("Gomeds 24/7," "we," "us," or "our").
For clarity: wherever these Terms refer to “Gomeds 24/7,” it shall mean the mobile application and digital platform owned and operated by AEON HEALTHCARE.
These Terms govern your access to and use of the GOMEDS 24/7 digital platform, including the website, mobile applications, and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not access or use the Platform.
1. Definitions and Interpretation
1.1 In these Terms, unless the context otherwise requires, the following terms shall have the following meanings:
- (a) "Prescription" means a valid and legally compliant medical prescription issued by a registered medical practitioner.
- (b) "Partner Pharmacy" means any independent pharmacy onboarded on the Platform providing medicines and pharmaceutical products.
- (c) "Partner Diagnostic Laboratory" means any diagnostic center or laboratory affiliated with the Platform.
- (d) "Order" means any request placed by a User via the Platform for the procurement of medicines, health-related products, or diagnostic services.
- (e) "Personal Data" means any information relating to an identified or identifiable natural person, as defined under applicable data protection laws.
- (f) "Applicable Laws" means all laws, statutes, regulations, and rules applicable to the use of the Platform.
1.2 Headings are for convenience only and shall not affect interpretation.
2. Nature of Services; No Agency or Employment Relationship
2.1 The Platform acts solely as a technology intermediary between Users and Partner Pharmacies or Partner Diagnostic Laboratories.
2.2 Gomeds 24/7 is not the seller or supplier of medicines or services offered. Responsibility for quality, safety, and compliance rests with Partners.
2.3All transactions are directly between the User and the Partner. Gomeds 24/7 is not liable for claims arising from such transactions.
2.4 Gomeds 24/7 does not provide medical advice. Users must consult qualified healthcare providers for medical concerns.
3. User Representations, Warranties, and Eligibility
Users confirm that they:
- (a) Are legally competent and at least 18 years of age (or legal age in their jurisdiction);
- (b) Provide accurate and updated information;
- (c) Comply with all Applicable Laws;
- (d) Maintain confidentiality of account credentials;
- (e) Do not misuse or submit fraudulent prescriptions.
4. Account Security
4.1 Users are solely responsible for safeguarding login credentials.
4.2 Users must immediately notify Gomeds 24/7 of any unauthorized use.
4.3 Gomeds 24/7 is not liable for losses from failure to secure account information.
5. Prescription Submission, Verification, and Pharmacist Authority
5.1 A valid prescription must be uploaded when required by law.
5.2 Forged or fraudulent prescriptions are prohibited.
5.3 Gomeds 24/7 is not responsible for damages from fake or invalid prescriptions.
5.4 Prescriptions are validated exclusively by licensed Partner pharmacists.
5.5 Pharmacists may reject prescriptions, refuse to dispense, or request clarifications.
5.6 Pharmacist decisions are final and binding.
6. Compliance with Laws and Regulations
Users must comply with all applicable laws regarding procurement and use of medicines and diagnostic services. Gomeds 24/7 disclaims liability for violations committed by Users.
7. Order Placement, Acceptance, and Status
7.1 Placing an order is an offer to purchase from the relevant Partner.
7.2 Acceptance is at the sole discretion of the Partner.
7.3 Orders remain “open” until fulfilled or cancelled.
7.4 Gomeds 24/7 is not liable for delays caused by Partners, logistics, or external events.
8. Delivery, Pickup, and Returns
8.1 Delivery may be provided by Partner Pharmacies or third-party logistics providers.
8.2 Delivery timelines are estimates only and not binding.
8.3 Returns are permitted for both pickup and delivery orders; however, the customer shall be responsible for returning the medicines to the designated pharmacy location in all cases, and pickup of returned medicines is not available at this time.
8.4 Users must inspect products upon receipt or pickup and return any damaged, expired, or incorrect products directly to the designated pharmacy within twenty-four (24) hours. Photographic or video proof must be submitted through the Platform or customer support.
8.5 Diagnostic test cancellations, rescheduling, or refund requests must be raised within twenty-four (24) hours of booking or as per Partner Laboratory policies, whichever is stricter. Proof of issue must be submitted through the Platform or customer support.
9. Pricing, Payment, and Taxation
9.1 Prices are provided by Partners and are indicative only. Final billing may vary.
9.2 Gomeds 24/7 does not guarantee lowest or most accurate pricing.
9.3 Platform fees, delivery charges, and taxes apply as per law. Platform fees are non-refundable except in cases of Partner error.
9.4 GST applicability will be displayed at checkout (inclusive or exclusive as applicable).
9.5 Payments must be made through authorized gateways. Gomeds 24/7 is not liable for payment failures.
9.6 COD may be offered subject to order value, location, and Partner policy. Refusal to pay on COD orders may lead to account suspension.
10. User Ratings, Feedback, and Content
10.1 Users may provide reviews and ratings.
10.2 By submitting content, Users grant Gomeds 24/7 a worldwide, royalty-free license to use it.
10.3 Gomeds 24/7 may remove objectionable or unlawful content.
10.4 Users must not post infringing or unlawful content.
11. Limitation of Liability and Indemnification
11.1 Gomeds 24/7 disclaims all warranties to the fullest extent permitted by law
11.2 Total liability shall not exceed the amount paid by the User for the disputed service.
11.3 Users indemnify Gomeds 24/7 against claims from violations of these Terms or laws.
12. Data Collection, Storage, and Retention
12.1 Gomeds 24/7 collects and processes Personal Data to provide services and comply with law.
12.2 Data may be shared with Partner Pharmacies and Partner Diagnostic Laboratories strictly for order fulfillment.
12.3 Data is retained for legally required durations.
12.4 Users may access, correct, or request deletion of data subject to legal retention requirements.
13. Intellectual Property
All rights in the Platform remain with Gomeds 24/7 or licensors. Users may not reproduce, distribute, or modify without prior consent.
14. Termination
Gomeds 24/7 may suspend or terminate access for violations or at its discretion. Rights accrued prior to termination remain enforceable.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Jurisdiction lies exclusively with the courts in Ahmedabad, Gujarat.
16. Miscellaneous
16.1 Invalid provisions shall not affect enforceability of remaining Terms.
16.2 These Terms, together with the Privacy Policy, form the entire agreement.
16.3 No waiver of rights is deemed a waiver of subsequent rights.
16.4 Users may not assign these Terms without prior consent.
17. Delivery Terms and Customer Responsibilities
17.1 Orders are delivered when received at the provided address by the User or authorized recipient.
17.2 If Users instruct delivery personnel to leave orders unattended or hand them to third parties, Gomeds 24/7 is not liable for resulting loss, theft, or deterioration.
17.3 Users waive claims against Gomeds 24/7 for issues arising from unattended delivery or third-party handover.
18. Accuracy of Information and Validation Rights
18.1 Users must provide accurate and complete information at all times.
18.2 Gomeds 24/7 reserves the right to verify information or documents through direct contact or third party services.
18.3 If information is found to be false or misleading, Gomeds 24/7 may reject registration, cancel orders, or suspend accounts.
19. Order Cancellation and Refund Policy
19.1 User-initiated cancellations are subject to approval by Gomeds 24/7 and not guaranteed.
19.2 Eligible refunds may be processed as monetary reimbursement, credits, or vouchers, subject to specific terms.
19.3 Gomeds 24/7 may cancel orders without liability in cases of:
- (a) suspected fraudulent activity;
- (b) violation of these Terms or laws;
- (c) unavailability of products;
- (d) technical or logistical failures;
- (e) unforeseen circumstances.
19.4 Refunds for medicine returns and diagnostic cancellations will be processed within seventy-two (72) hours of approval, routed through the original payment method where possible, subject to banking and gateway timelines.
20. Force Majeure
Gomeds 24/7 shall not be liable for delays or failures caused by events beyond reasonable control, including natural disasters, strikes, outages, government actions, pandemics, or civil unrest.
21. Modifications to Terms
Gomeds 24/7 may modify these Terms at any time. Updated Terms will be communicated through the Platform. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
